Defendant appealed his sex crime conviction for rape of his wife in the Circuit Court of Loudoun (Virginia). Defendant claimed that the conviction had to be reversed because it was impossible for a husband to rape his wife under Va. Code Ann. § 18.2-61, where, at the time of the alleged offense, the parties were living separate and apart.

The Virginia Court made the following holding:
  • When a wife is living apart from her husband in her own dwelling, one in which he has no proprietary interest, the husband’s right of consortium is subordinate to the wife’s right of exclusive possession. A husband cannot be guilty of a rape on his wife. However, with an order of separation, the wife’s consent to sexual intercourse can be revoked by process of law. The husband cannot be guilty of a rape committed by himself upon his lawful wife, for by their mutual matrimonial consent and contract the wife hath given up herself in this kind unto her husband, which she cannot retract.
