Under Virginia law, solicitation of a prostitute is offering money or another inducement for a sexual act and then performing “a substantial act in furtherance thereof”. It is a class 1 misdemeanor punishable by up to 12 months in jail. However if the prostitute is a minor 16 years or older it is punishable by up to 5 years in prison. If the minor is under 16 years old it is punishable by up to 10 years in prison. In addition to the legal punishments there is a social stigma of having a conviction for such a crime on your record.
